Les présentes conditions régissent les droits et obligations de la société Procyclingmaps SAS, identifiée comme www.procyclingmaps.com, sur le site internet www.procyclingmaps.com uniquement.
Les présentes conditions sont applicables uniquement aux produits ou services vendus sur le site www.procyclingmaps.com ainsi que les achats directs en magasin.
Les présentes conditions s’adressent à un acheteur qui dispose de sa pleine capacité juridique. Ces conditions s’appliquent à l’ensemble des commandes passées auprès de www.procyclingmaps.com.
En cas de modification, il sera appliqué à chaque commande les conditions générales de vente en vigueur au jour de la commande.
Ces conditions générales de vente applicables à la boutique en ligne www.procyclingmaps.com sont rédigées en langue française, qui est la seule à faire foi.
ARTICLE 2 – L’OFFRE
L’offre de la société www.procyclingmaps.com comprend :
– la vente d’ouvrages, aux formats PAPIER et NUMERIQUE,
– la vente d’affiches ou visuels.
www.procyclingmaps.com est le concepteur et/ou fabricant des produits vendus sur son site. Toutes les caractéristiques présentées (description, photos…) sont des informations fournies ses soins et dûment vérifiées.
Dans un souci du respect des normes en vigueur, procyclingmaps.com étudie scrupuleusement la qualité de fabrication des articles qu’il vend.
L’offre est ouverte à la France métropolitaine, à l’Union européenne et au reste du monde à l’exception de quelques pays où les conditions de livraison ne peuvent pas être assurées. Ces pays sont mentionnés comme tel lors de la commande et le client est invité à reporter sa commande.
Au-delà, des conditions de prix et de livraison spécifiques s’appliquent en fonction du lieu de l’acheteur et de la destination finale du produit.

ARTICLE 3 – DISPONIBILITÉ DES PRODUITS
Dès réception de la commande, www.procyclingmaps.com vérifie la disponibilité du (ou des) produit(s) commandé(s). En cas d’indisponibilité, nous nous engageons dans les 45 jours à compter de la validation de la commande soit à vous livrer le produit commandé, soit à vous proposer un produit similaire à un prix similaire, soit à vous le rembourser.
La date de validation de la commande correspond à :
– La date du règlement en cas de paiement par carte bancaire en ligne.
– La date de la réception du virement en cas de paiement par virement (bancaire ou Paypal)
En cas de rupture de stock exceptionnelle sur l’un des produits de votre commande, nous pouvons expédier le reste de votre commande avec votre accord.
En cas d’indisponibilité d’un produit après passation de la commande, le client en sera informé par email. La commande sera automatiquement annulée et aucun débit bancaire ne sera effectué.
ARTICLE 4 – LE PRIX
Tous les prix des articles ou services proposé sont indiqués en Euros Toutes Taxes Comprises (TVA et autres taxes applicables au jour de la commande), sauf indication contraire et hors frais de traitement et d’expédition des produits.
www.procyclingmaps.com se réserve le droit d’appliquer des réductions et avoirs exceptionnels. L’acheteur devra confirmer son consentement à un changement d’offre, et celui-ci se verra remettre une confirmation de la modification du prix de l’offre.
Les prix hors livraison sont valables en France et à l’étranger. Le taux de TVA alors en vigueur est appliqué, pour la France.
En cas de commande vers un pays autre que la France métropolitaine vous êtes l’importateur du ou des produits concernés. Des droits de douane ou autres taxes locales ou droits d’importation ou taxes d’état sont susceptibles d’être exigibles. Ces droits et sommes ne relèvent pas du ressort de la société.
www.procyclingmaps.com s’accorde le droit de modifier ses tarifs à tout moment. Cependant, les articles commandés seront facturés aux prix indiqués lors de la validation de la commande.
Les produits sont propriété de www.procyclingmaps.com jusqu’au règlement complet de la commande.
Dès réception complète de la commande, les risques liés au produit sont transférés à l’acheteur.
ARTICLE 5 – RÉALISATION ET VALIDATION DE LA COMMANDE
Une commande se compose de plusieurs étapes :
1- La demande de l’acheteur.
2- La validation de la demande par la société.
3- Le règlement de(s) produit(s) par l’acheteur.
4- La livraison de(s) produit(s) à l’acheteur.
Toute commande passée surwww.procyclingmaps.com suppose la création préalable d’un compte client mais la commande sans compte client est cependant admise.
Toute commande passée sur www.procyclingmaps.com comporte 4 étapes :
1- Ajout des articles dans le panier.
2- Saisie de vos coordonnées de facturation et livraison.
3- Récapitulatif et validation finale de votre commande.
4- Accès au moyen de règlement sélectionné dans votre panier.
Une commande sera considérée comme valide lorsque ces 4 étapes auront été convenablement effectuées et que l’acheteur aura cliqué sur « valider » ou tout autre formulation finalisant l’achat, en langue française ou anglaise.
Le fait de valider votre commande implique pour l’acheteur l’obligation de payer en totalité le prix indiqué.
Un courriel de confirmation de la commande sera envoyé à l’acheteur à l’adresse indiquée par celui-ci. Il récapitulera les détails des produits commandés, leur prix, les taxes et réductions éventuelles, les informations de contact et le mode de livraison choisi.
L’acheteur s’engage à fournir les informations nécessaires à la complète réalisation de la commande (facturation et livraison). Ces informations doivent être exactes et légales.
Au cas contraire, www.procyclingmaps.com se réserve le droit d’annuler la commande et ne sera responsable des dommages liés à la non-réalisation de la commande.
Une demande de modification de la commande par mail est envisageable avant que celle-ci ne soit expédiée, sans garantie su le délai de traitement.
Une modification de quantité ou de produit sera étudiée au cas par cas par le service client et www.procyclingmaps.com se réserve le droit d’accepter ou de refuser le changement de commande.
Une fois la commande expédiée, la commande ne peut plus être modifiée et le règlement total de la commande est dû par l’acheteur.
L’acheteur peut toutefois effectuer une demande d’échange ou de remboursement selon les conditions de retour d’échange et de rétractation (voir les articles 9 et 10 des CGV).
ARTICLE 6 – MODALITÉS DE PAIEMENT ET SÉCURISATION
Modalités de Paiement
Vous pouvez effectuer le règlement :
– par Carte bancaire :
Le paiement s’effectue sur un serveur sécurisé. Ceci implique qu’aucune information bancaire vous concernant ne transite via le site www.procyclingmaps.com. Votre commande sera ainsi enregistrée et validée dès l’acceptation du paiement.
Avec le protocole 3D Secure, votre transaction est entièrement sécurisée. Vous devez simplement entre le code reçu par SMS sur votre portable.
Le montant minimum requis pour paiement par carte bancaire est de 0.01 Euros (€).

Le paiement s’effectue via la plateforme de paiement en ligne sécurisée Paypal.
Vous devez préalablement possédez un compte Paypal avant de pouvoir effectuer le règlement de la commande.
À noter que les règlements avec Paypal peuvent nécessiter des délais supplémentaires (vérification par la banque) avant de de voir le compte débité, ce qui peut retarder la validation de la commande et son expédition.
– Google Pay/Apple Pay
La commande ne pourra être validée que lorsque la réception du virement sera confirmée par www.procyclingmaps.com.
Sécurisation
Le fait de communiquer votre numéro de carte de crédit sur le serveur bancaire au moment du paiement de la commande est entièrement sécurisé.
En effet, cette manipulation ne comporte aucun risque puisque les coordonnées de la carte de crédit ne transitent jamais en clair sur le réseau : elles sont chiffrées grâce au protocole SSL (Secure Socket Layer). Notre société ne conserve en aucun cas ces coordonnées après la transaction. C’est pourquoi elles sont demandées à chaque nouvelle transaction sur notre site.
www.procyclingmaps.com utilise le protocole SSL V3 de la plateforme WooCommerce, et un certificat TSL/SSL sécurisé par Sectigo pour le compte de OVH, pour chiffrer les transactions de paiement avec ses clients : l’interception des données est ainsi rendue impossible. L’utilisation de ces certificats déclenche l’affichage de la barre d’adresse en vert dans le navigateur, ainsi que l’affichage du nom de l’organisation propriétaire du certificat, à savoir la société Procyclingmaps.
Conformément à la loi Informatique et Libertés du 6 janvier 1978 le client dispose, à tout moment, d’un droit d’accès, de rectification, et d’opposition à l’ensemble de ses données personnelles en écrivant, par courrier et en justifiant de votre identité, à :

Clause de réserve de propriété
Les produits demeurent la propriété de www.procyclingmaps.com jusqu’à la finalisation complète de la commande : règlement complet de la commande par l’acheteur et livraison terminée par www.procyclingmaps.com.
Comme vu précédemment, à la livraison complète des produits, les risques des marchandises livrées sont transférés au client.
Défaut de Paiement
www.procyclingmaps.com se réserve le droit de refuser d’effectuer une livraison ou d’honorer une commande émanant d’un consommateur qui n’aurait pas réglé totalement ou partiellement une commande précédente ou avec lequel un litige de paiement serait en cours.
Nous considérons qu’un défaut de paiement survient 30 jours après la date de la commande ou si le moyen de paiement utilisé n’a pas pu être validé (virement invalide, blocage de l’établissement bancaire etc.).
Auquel cas, www.procyclingmaps.com se réserve le droit de suspendre ou annuler la commande et pourra prendre contact avec le client.
ARTICLE 7 – MODALITÉS DE LIVRAISON ET DÉLAIS
Pour une livraison en France métropolitaine :
- Les produits sont livrés à l’adresse de livraison indiquée au cours de la commande.
- Toutes les expéditions sont assurées à la valeur réelle de la marchandise.
- Nous conseillons de contrôler systématiquement la marchandise au moment de la livraison.
- Nous déclinons toute responsabilité dans le cas de retards dus aux grèves, catastrophes naturelles, actes de terrorisme, vols et cas de force majeure.
Les frais d’expédition sont gratuits dès 20 euros TTC d’achat sur le site www.procyclingmaps.com pour l’Union européenne, la France, Andorre et Monaco.
Pour une livraison en Union européenne :
- Les produits sont livrés à l’adresse de livraison indiquée au cours de la commande.
- Toutes les expéditions sont assurées à la valeur réelle de la marchandise.
- Nous conseillons de contrôler systématiquement la marchandise au moment de la livraison.
- Nous déclinons toute responsabilité dans le cas de retards dus aux grèves, catastrophes naturelles, actes de terrorisme et cas de force majeure.
Les frais d’expédition sont gratuits dès 20 euros TTC d’achat sur le site www.procyclingmaps.com pour les pays membres de l’Union européenne.
Pour une livraison hors Union européenne :
- Les produits sont livrés à l’adresse de livraison indiquée au cours de la commande.
- Les expéditions ne sont pas assurées à leur valeur.
- Nous conseillons de contrôler systématiquement la marchandise au moment de la livraison.
- Nous déclinons toute responsabilité dans le cas de retards dus aux grèves, catastrophes naturelles, actes de terrorisme et cas de force majeure.
- Nous déclinons toute responsabilité en cas de perte, vol, dégradation ou difficulté de livraison causée par des causes externes à la volonté de Procyclingmaps.
Les frais d’expédition sont facturés 9.90 euros ou davantage pour tout achat sur le site www.procyclingmaps.com pour les pays non membres de l’Union européenne, hors Andorre et Monaco. Les tarifs sont indiqués systématiquement avant la commande et toute validation de celle-ci vaut acceptation définitive.
Délais d’expédition
Tout article disponible en stock est expédié sous 5 jours ouvrés au plus tard ou moins. Exceptionnellement, ce délai pourra être porté à 45 jours en cas de circonstance exceptionnelle indépendante de la volonté de Procyclingmaps ou en cas de commercialisation sous la forme d’une prévente avant réception du stock.
Les délais annoncés sont des délais moyens qui correspondent aux délais de traitement, de préparation et d’expédition de votre commande.
Délais de livraison
Le(s) produit(s) commandé(s) sont livrés via les services que nous proposons et avec qui Procyclingmaps a contracté.
Les délais annoncés sont indiqués au départ de notre entrepôt et dépendent du service garanti par le choix du mode de livraison.
Le choix du mode de livraison dépend du poids, du volume et de la valeur des articles.
À la Livraison
Vous devez vérifier la conformité de la marchandise livrée au moment de la livraison et avant de signer le bon de livraison du transporteur.
Vous devez indiquer sur le bon de livraison et sous formes de réserves manuscrites accompagnées de votre signature toute anomalie concernant la livraison (produit endommagé, manquant etc.).
Cette vérification est considérée comme effectuée dès lors que l’acheteur, ou une personne autorisée par lui, a signé le bon de livraison.

Nous vous conseillons de bien vérifier votre adresse de livraison lors du récapitulatif de commande. En cas d’erreur sur l’adresse de livraison (adresse, numéro, nom etc.), des frais de port pour une nouvelle expédition seront à la charge du client.
ARTICLE 8 – RESPONSABILITÉS
Extrait applicable de la Loi française n°2004/575 du 21 juin 2004 (extrait) :
« Le professionnel est responsable de plein droit à l’égard du consommateur de la bonne exécution des obligations résultant du contrat conclu à distance, que ces obligations soient à exécuter par le professionnel qui a conclu ce contrat ou par d’autres prestataires de services, sans préjudice de son droit de recours contre ceux-ci.
Toutefois, il peut s’exonérer de tout ou partie de sa responsabilité en apportant la preuve que l’inexécution ou la mauvaise exécution du contrat est imputable, soit au consommateur, soit au fait, imprévisible et insurmontable, d’un tiers au contrat, soit à un cas de force majeure. »
ARTICLE 9 – DROIT DE RÉTRACTATION
Conformément à l’article L.121-21 du Code français de la Consommation et conformément à la réglementation européenne, l’acheteur dispose d’un délai de 14 jours ouvrables à compter de la date de la conclusion du contrat de vente.
Dans le cas de www.procyclingmaps.com il s’agit de la date de livraison de la commande complète au client.
L’acheteur peut retourner tout article ne lui convenant pas et demander l’échange ou le remboursement sans pénalité, à l’exception des frais de retour qui seront intégralement à sa charge.
Le produit devra être retourné en excellent état, accompagné de tous ses accessoires et protections ou étiquettes, et non usagé.
Dans la mesure du possible, ils devront nous être retournés dans leurs conditionnements d’origine et ne doivent pas avoir été ouverts, ni utilisés.
Le cas échéant en cas de dégradation ou utilisation manifeste, Procyclingmaps se réserve le droit de ne pas procéder à l’échange ou au remboursement.
EXCEPTIONS AU DROIT DE RÉTRACTATION
Conformément aux dispositions de l’article L.121-21-8 du Code de la Consommation français, le droit de rétractation ne s’applique pas aux produits personnalisés et confectionnés selon les spécifications du consommateur, cela comprend notamment tout ouvrage numérique, ebook ou fichier.
Tout article ayant subi une modification spécifique pour l’acheteur ne pourra faire l’objet d’une demande de rétractation.
ARTICLE 10 – DROIT DE RETOUR ET D’ÉCHANGE
Pour bénéficier d’un remboursement ou de l’échange d’un article, l’acheteur dispose d’un délai de 14 jours à compter de la réception de la commande pour la retourner à ses frais (article L.121-21 du Code de la Consommation).
www.procyclingmaps.com procédera au remboursement total des sommes versées (à l’exception des frais de port) dès réception des produits ou dès que le renvoi des produits est confirmé.
Le remboursement se fera via le même moyen de paiement que celui utilisé lors de la commande, sauf avec l’accord commun entre l’acheteur et www.procyclingmaps.com. Le cas échéant, un remboursement par virement bancaire pourra être effectué.
Dans le cas d’un échange d’article, www.procyclingmaps.com enverra le nouveau produit dès que le produit à échanger aura été retourné à www.procyclingmaps.com ou sur preuve d’envoi du client.
www.procyclingmaps.com se réserve le droit de demander à l’acheteur une participation totale ou partielle aux frais de port et de conditionnement pour le nouvel envoi.
ARTICLE 11 – GARANTIE ET SAV
Selon l’article L. 211-4 et suivants du Code de la Consommation et des articles 1641 et suivants du Code Civil, l’acheteur bénéficie de la garantie légale des vices cachés et le vendeur est tenu responsable des défauts de conformité.
En cas de non-conformité, le produit pourra être retourné, échangé ou remboursé.
Toutes les réclamations, demandes d’échange ou de remboursement doivent s’effectuer dans un délai de 30 jours suivant la livraison par voie de courrier électronique : contact@procyclingmaps.com.
Ou par courrier à l’adresse précitée.
Les produits doivent être retournés dans l’état dans lequel ils ont été reçus avec l’ensemble des éléments (accessoires, emballage, hologramme de sécurité, notice etc.).
Les frais d’envoi seront remboursés sur la base du tarif facturé et les frais de retour seront remboursés sur preuve du ou des défauts du produit concerné.
Les dispositions de cet article ne vous empêchent pas de bénéficier du droit de rétractation prévu à l’article 9 des présentes conditions de vente.
ARTICLE 12 – DROIT APPLICABLE EN CAS DE LITIGES
La langue du présent contrat est la langue française. Les présentes conditions de vente sont soumises à la loi française. En cas de litige, le tribunal de Montauban (Tarn-et-Garonne, France) sera le seul compétent.
ARTICLE 13 – PROPRIÉTÉ INTELLECTUELLE

Shipping times
Any item available in stock is dispatched within 5 working days at the latest or less. At the delivery

ARTICLE 8 – RESPONSIBILITIES

ARTICLE 9 – RIGHT OF WITHDRAWAL
In accordance with article L.121-21 of the French Consumer Code and in accordance with European regulations, the buyer has a period of 14 working days from the date of conclusion of the sales contract.
In the case of procyclingmaps.com, this is the date of delivery of the complete order to the customer.
The buyer may return any item that does not suit him and request an exchange or refund without penalty, with the exception of the return costs which will be entirely at his expense.
The product must be returned in excellent condition, with all its accessories and protections or labels, and unused.
As far as possible, they must be returned to us in their original packaging and must not have been opened or used.
If necessary, in the event of degradation or obvious use, Procyclingmaps reserves the right not to proceed with the exchange or refund.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

Any article having undergone a specific modification for the buyer cannot be the subject of a request for withdrawal.
ARTICLE 10 – RIGHT OF RETURN AND EXCHANGE
To benefit from a refund or exchange of an article, the buyer has a period of 14 days from receipt of the order to return it at his expense (article L.121-21 of the Code consumption).
procyclingmaps.com will proceed to the total reimbursement of the sums paid (with the exception of shipping costs) upon receipt of the products or as soon as the return of the products is confirmed.

According to article L. 211-4 and following of the French Consumer Code and articles 1641 and following of the French Civil Code, the buyer benefits from the legal guarantee against hidden defects and the seller is held responsible for defects of conformity.
In the event of non-compliance, the product may be returned, exchanged or refunded.
